Trump wins in court again

The US Supreme Court just reversed an important ruling regarding immigrants.

The decision reverses a prior ruling made by the U.S. Circuit Court of Appeals for the 9th Judicial Circuit.
It held that immigrants being detained pending deportation have right to a status hearing every six months,
to give them the opportunity to challenge the legitimacy of their detention.

The detained affected immigrants include:
• Lawful permanent residents charged with a crime;
• Those detained at the border seeking entry who might lack valid documentation; and,
• Those claiming fear of persecution if they return to their home country.

The 9th Circuit based its decision on the Canon of Constitutional Avoidance, a principle that provides
that the court “should avoid ruling on constitutional issues, and resolve the cases before them on other
(usually statutory) grounds” whenever possible.

Justice Samuel Alito explained that the principle does not apply in this case, since the words of
the statute on which the lower court relied did not provide for bail hearings for detained immigrants.
“That is not how the canon of constitutional avoidance works,” Alito wrote. “Spotting a constitutional
issue does not give a court the authority to rewrite a statute as it pleases.”

It is not the win loss record, but the judges should follow the law and not makes things up as a lot of liberal judges do.

Trump seems to be picking up a little steam in the courts.

"Yesterday, a federal judge in Maryland ruled that President Trump indeed does have the constitutional authority to end the so-called DACA program. Judge Roger Titus also admonished those of his colleagues who've allowed their personal views to influence their decisions..."

"And last week, Judge Curiel, also an Obama appointee, ruled that the border wall can proceed, ruling against environmental groups and the state of California and deferring to the president's powers on any matter of national security."

Defiant CA AG Becerra Loses Sanctuary State Funding Injunction

When the Trump administration decided to withhold federal law enforcement grant funds from California because of its sanctuary laws, Attorney General Xavier Becerra promised to #resist and fight through the courts. His resistance hit a roadblock, though, Monday when a federal judge in Northern California denied Becerra’s Motion for Preliminary Injunction in the case.
